Terms of service

Your account

• You must be 13 or older. If you’re under 18, you need a parent or guardian’s permission.
• Give accurate information, keep your password and PIN private, and tell us if you think someone else is using your account.
• You’re responsible for what happens in your account.

Your friends and text messages

Only add people who have agreed to be your safety contacts and to receive texts, emails and automated calls from Panic about you. Tell them Panic exists; the app can send them a heads-up when you add them. They can reply STOP at any time.

Using Panic fairly

Don’t use Panic to:

• send spam, prank or false alarms on purpose, or messages to people who didn’t agree to them;
• harass, stalk, threaten or track anyone without their knowledge;
• break the law, or upload content you don’t have the right to share;
• attack, overload, scrape or reverse-engineer the service, or get around its limits.

We may suspend or close accounts that break these rules. A suspended account can still end a check-in that’s already running.

Plans and payments

• Panic is a paid service. Basic costs $3.99 a month or $35.99 a year, Plus $7.99 a month or $69.99 a year, Pro $14.99 a month or $129 a year, and Family $24.99 a month or $219 a year (US dollars, plus any tax). You can switch plans any time; the difference is charged or credited right away.
• Each plan includes a number of friends, texts, emails and videos, shown on the plan page; texts, emails and videos are counted over the last 30 days, and a family plan shares one allowance. Alarm alerts to your friends are never limited.
• New accounts may get a 3-day free trial, once per person. When it ends, your account is paused until you choose a plan: a check-in already running can still be finished. We don’t charge you without asking.
• If an account never chooses a plan, we delete it, with its friends list and history, 14 days after sign-up. We email a reminder before we do.
• Paid plans renew automatically until you cancel. Cancel any time in Settings → Your plan → Manage; you keep Plus until the end of the period you paid for.
• Payments are non-refundable except where the law requires, but if something went wrong, email us and we’ll make it right.
• If we change prices, we’ll tell you at least 30 days before your next renewal.
• Gift codes and free time from invites can’t be exchanged for cash.

Recording and the law

Panic can record sound and video: when you choose to, when an alarm goes off (if you turned that on), and on walks (if you turned that on). Some states, and some countries, require everyone in a conversation to agree before it is recorded. Others allow it if one person agrees. Laws also differ for private places, and for video.

States that require everyone’s consent include California, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania and Washington, and in some situations Connecticut, Michigan, Nevada and Oregon (this list may change and other countries have their own rules).

You alone are responsible for every recording you make with Panic: for telling the people you record, and for getting their consent wherever the law requires it. You confirmed this when you created your account. Panic, its owners and its staff are not responsible for your recordings or for whether you had the consent you needed, and you agree to cover any claim against us that arises from your recordings. Panic doesn’t know who is nearby or what they agreed to. If you’re not sure, tell people you’re recording, or turn automatic recording off in Settings → Check-in defaults.

Your content

What you write and record stays yours. You let us store it, process it (for example, converting video so it plays on every phone) and show it to the people the app is designed to show it to, only to run Panic.

Changes and ending

We may improve or change Panic. If we change these terms in a way that matters, we’ll tell you before it takes effect; using Panic after that means you accept the new terms. You can stop using Panic and delete your account at any time.

Warranty and liability

Panic is provided “as is” and “as available”. To the extent the law allows, we don’t promise that it will always work, be error-free, or deliver every message on time, and we are not liable for indirect or consequential losses, or for harm caused by a failure to send or receive an alert. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim or $50. Some places don’t allow these limits, so they may not all apply to you.

You agree to cover our reasonable costs if a claim against us is caused by your breaking these terms.

The law that applies

These terms are governed by the laws of Kentucky, USA, and disputes go to the courts there, except where your local consumer law says otherwise.
